The Quick Divorce procedure

The law is making it easier and easier for married couples to get divorced and while the issue is hotly debated, the fact remains that if a couple are able to agree on the terms of their divorce and they approach the special divorce courts, a divorce can be finalised within 30 days at minimal cost.

An uncontested divorce is one where both parties agree on the terms of the divorce namely, maintenance of children, custody and visitation of children, division of assets. There are a few conditions to applying for a quickie divorce as they are often referred to.

  • Both parties must have been residents of South Africa for at least 1 year.
  • The wife must not be pregnant.
  • All aspects of the settlement are agreed upon.
  • The whereabouts of both parties must be known and the documents signed.

Both parties to the divorce are not required to be present at the hearing and granting of a divorce done in the special divorce courts, but the applicant must be present.

The main reason for the establishment of the special divorce courts was to make divorce affordable to the majority of the population by negating the need to consult an attorney and to reduce the pressure on the high court rolls.
